SACRAMENTO – In this Democratic weekly address, Assemblymember John A. Pérez (D-Los Angeles), Chair of Assembly Democratic Caucus, calls the line-item vetoes Governor Arnold Schwarzenegger made to budget solution bills passed by the legislature last week illegal. Pérez says “according to the California Supreme Court, the Governor’s authority to line-item veto only applies to new appropriations,” but that the bills the governor made line-item vetoes to this week only made cuts to the budget he already signed and made line-item vetoes to in February. Pérez says “Our State Constitution only allows the Governor to reduce or eliminate spending when it is first enacted,” and that, “He does not get a second bite at the apple now.”

Hello, this is Assemblyman John Pérez, Chair of the Assembly Democratic Caucus.
This week, the Governor took action that will trigger a constitutional crisis in the State of California.
At issue are illegal vetoes the Governor made to the Budget Bills passed by the legislature by two-thirds majority this last week.
Under the Constitution, the Governor may veto any bill passed by the legislature. When it comes to the budget the Governor is empowered with a “Line Item Veto,” which allows the governor to selectively reduce spending without having to veto the entire budget. In the past, governors have used this power sparingly, respecting the will and intent of the Legislature.
What the Governor did, however, was to veto funding he had already approved with his signature this past winter. As you may recall, the Legislature passed this year’s budget in February. That budget was signed by the Governor. Due to lower than expected revenues, the Legislature was forced to make additional cuts to that previously approved budget. Those cuts are reflected in the bills sent to the Governor this last week.
This is the crux of the issue. According to the Supreme Court, the Governor’s authority to line-item veto only applies to new appropriations…that is, only new spending. The fact that the Legislature reduced previously approved spending in the bill package does not make this a new appropriation. Our State Constitution only allows the Governor to reduce or eliminate spending when it’s first enacted. He does not get a second bite at the apple now.
In all, the illegal cuts the governor made – beyond the already deep cuts passed with bipartisan approval in both houses of the legislature – total $487 million.
Governor Schwarzenegger’s vetoes took:
- $50 million from Healthy Families, which provides healthcare to children in low-income families,
- $50 million from services for developmentally delayed children under the age of 3,
- $52.2 million from the Office of AIDS Prevention and Treatment,
- $16.3 million from domestic-violence programs,
- $6.3 million from services for the elderly.
In addition, the Governor took another 6 million dollars from the state parks system, which will double the number of parks that will be forced to close.
These cuts are not only morally wrong, they are illegal in the eyes of the law and will likely be overturned by the legal challenges in the court.
The Governor’s willingness to put our state through a costly court battle to defend his illegal power grab is shameful.
Democrats will continue to stand for our constitutional system, which balances power between the three branches of government.
Democrats will not abandon the most sick and vulnerable Californians any more than we will abandon the Constitutional principles on which our state and nation were founded.

Pérez (D- Los Angeles), declara que los vetos parciales del gobernador Arnold Schwarzenegger a las soluciones para el presupuesto aprobadas por la Legislatura la semana pasada son ilegales. Pérez dice que de “acuerdo a la Corte Suprema de California, la autoridad del gobernador de hacer vetos parciales solamente aplica a las nuevas apropiaciones,” pero los proyectos de ley en el cual el gobernador aplicó los vetos parciales esta semana fueron a un presupuesto que ya había sido promulgado y vetado parcialmente en febrero. Pérez señaló que “Nnuestra constitución del Estado sólo permite al Gobernador reducir o eliminar gastos cuando son creados a través del presupuesto. Y por esa misma razón no le toca una segunda mordida a la manzana.”

Hola, les habla el Asambleísta John A. Pérez, Presidente del Bloque Demócrata de la Asamblea Estatal.
Esta semana, el Gobernador tomó medidas que han causado una crisis constitucional en el Estado de California.
En cuestión son los vetos ilegales que tomo el Gobernador para recortar el presupuesto estatal que fue aprobado por una mayoría de dos tercios de la Legislatura la semana pasada.
Bajo la Constitución Estatal, el Gobernador tiene la habilidad de vetar cualquier proyecto de ley aprobado por la Legislatura. En lo que se refiere al presupuesto, el Gobernador tiene a su disposición el "Veto de Línea", que permite al gobernador reducir gastos selectivamente sin tener que vetar todo el presupuesto. En el pasado, los gobernadores han utilizado este poder con moderación, respetando la voluntad y la intención de la Legislatura.
Sin embargo, lo que hizo el Gobernador, fue vetar fondos para proyectos que ya había aprobado con su firma el invierno pasado. Como recordará, la Legislatura aprobó el presupuesto del estado este año en febrero. Presupuesto que fue firmado y convertido en ley por el Gobernador. Debido a los ingresos inferiores a los previstos, la Legislatura se vio obligada a hacer recortes adicionales. Estos se reflejan en los proyectos de la ley enviados al Gobernador la semana pasada.
Aquí esta el problema. Según la Corte Suprema Estatal, el Gobernador tiene la autoridad del veto de línea sólo cuando se trata de nuevos créditos..., es decir, sólo sobre nuevos gastos. El hecho de que la Legislatura, en este el proyecto de ley, redujo gastos previamente aprobados y no crea nuevas asignaciones al presupuesto. Nuestra Constitución del Estado sólo permite al Gobernador reducir o eliminar gastos cuando son creados a través del presupuesto. No le toca una segunda mordida a la manzana.
En total, los cortes ilegales que el gobernador hizo - más allá de los cortes profundos aprobados por ambos partidos de la Legislatura - representan $487 millones.
Los vetos que el Gobernador Schwarzenegger tomó son:
- 50 millones de dólares de Healthy Families, que ofrece cobertura de salud, atención dental y de cuidado de la vista a los niños que no tienen seguro médico, a familias de bajos ingresos,
- 50 millones de dólares de los servicios para menores de 3 años con retrasos de desarrollo,
- 52 millones de la Oficina de Prevención y Tratamiento del SIDA,
- 16 millones a los programas de prevención de la violencia doméstica,
- 6 millones a los servicios para personas de la tercera edad.
Además, el Gobernador tomó otros 6 millones de dólares del sistema de parques estatales, que duplicará el número de parques que se verán obligados a cerrar.
Estos recortes no son sólo corruptos moralmente, sino también son ilegales en los ojos de la ley y serán probablemente anulados por la corte.
Es vergonzoso que el Gobernador este dispuesto a poner a nuestro estado a través de una costosa batalla judicial para defender su avaricia del poder.
Los demócratas se mantenían firmes para defender nuestro sistema constitucional, que crea controles y equilibrios de poder entre las tres ramas del gobierno.
Los demócratas no abandonarán a los enfermos y vulnerables de nuestro estado como también no abandonaremos los principios de la Constitución en la que nuestro estado y nación se fundó.
