A president’s or governor’s ability to pardon or commute sentences is firmly established in our constitutional structure of checks and balances. In fact, the power is rooted in ancient law and exists in most civilized nations today. The concept stems from the thought that there needs to be mercy injected in the system of punishment or an opportunity to mitigate a punishment, and also the recognition that the criminal justice system can be imperfect.
