2010 Legislative Summary


AB 347: Charitable Tax Deductions for Haiti.
Signed by the Governor, Chapter 8 – Statutes of 2010.
AB 347 allows an individual and/or corporate taxpayers who make cash contributions to charitable organizations for earthquake relief efforts in Haiti from January 11th 2010 until March 1st 2010 to take a tax deduction in the 2009 tax year.

AB 434: K-12 After School Programs
AB 434 makes two technical changes to the Education Code in regards to after school programs. One change reduces the requirement of local fundraising designed to ease the fundraising burdens on after school programs; the other change clarifies the costs of an onsite supervisor as being considered “direct service”.

AB 1178: Reduce Cost of Textbooks / Close Corporate Tax Loophole
This bill would close a tax loophole by requiring corporations that move California sourced income to offshore tax haven countries for the purposes of sheltering that income and avoiding their fair share of California taxes to include that income on their California tax returns. The Franchise Tax Board estimates that this would generate $120 million per year to help address the increased costs to higher education students.  The bill would also reduce the sales tax burden imposed on textbooks and supplies purchased by students attending a UC, CSU, or California Community College by a partial exemption of the state sales tax.  Therefore, AB 1178 will have no net change on taxpayer revenue.

AB 1223: Multiple Pathways / Linked Learning Recognition Study
AB 1223 authorizes the California Commission on Teacher Credentialing to form a work group for the purposes of defining and issuing a “recognition of study”. This “recognition of study” acknowledges a completed field of study in multiple pathways/linked learning competence for holders of an appropriate single-subject teaching credential.

AB 2058: Unemployment Benefits – Recognition Training
This bill would allow unemployed workers receiving Unemployment Insurance (UI) benefits to continue their coverage while enrolled in job training or education courses to develop the skills necessary for our state’s changing workforce. As it stands, some recipients of UI lose their coverage when they seek training, causing an unfair hardship for many Californians in need.

AB 2190: Recognition of Federal Form for Servicemember Remains
This bill would recognize in state law the federally mandated Defense Department Form 93 ("Record of Emergency Data") as an acceptable written instrument of will for military service members. This form allows service members to designate a person authorized to direct disposition of their remains in event of death.

AB 2262: Re-Entry Identification Cards
AB 2262 would direct the Department of Corrections and Rehabilitation to establish a pilot program at four facilities to provide inmates prior to their release, a valid California identification card issued by the Department of Motor Vehicles (DMV). This would remove a significant barrier for parolees in successfully reentering our communities.

AB 2272: Class Size Reduction Assistance
This bill helps schools use more of their K-3 class size program money if they keep these classes to no more than 24 students. In exchange for additional funds, school districts would face steeper penalties for classes of more than 24 students. AB 2272 is the only state legislation to preserve the academic achievement of California’s youngest students by curbing severe overcrowding in elementary schools.

AB 2294: Local Pedicab Regulation
AB 2294 would define “pedicab” in the California Vehicle Code as a bicycle operated by a person used for transporting passengers for hire and would allow a city or county to require operators of pedicabs to obtain a California driver’s license from the Department of Motor Vehicles (DMV) as part of its pedicab license.

AB 2314: Disabled Veterans – Property Tax Exemption
A disabled veterans’ property tax exemption is available to persons with a 100% disability rating from the U.S. Dept. of Veterans Administration.  The exemption is also available to surviving spouses of persons killed in active duty.  This bill would give veterans more time, 90 days up from 30, to file this exemption.

AB 2369: Military Voting by Fax
AB 2369 lifts the sunset and permanently extends the provision allowing overseas voters to return completed ballots by facsimile transmission.

AB 2400: Community College Baccalaureate Pilot Program
This bill would establish a pilot program to authorize three community college districts to grant bachelor’s degrees in specific areas with high workforce shortages in the local area.  The program will be self financed and would sunset eight years after the first class of students begins the program.  The districts will submit a report to the Legislature examining the program’s success.

AB 2401: CSU Local Service Areas
This bill would formally recognize the long-standing California State University (CSU) “local service area” policy. AB 2401 establishes that priority admission be given to qualified students within a campus’ local service area.

AB 2402 would require the CSU campuses to notify the public and key stakeholders of any change in their admissions policy for students within a campus’ local service area.

AB 2548: CURES Enforcement
AB 2548 seeks to provide authority to the Prescription Drug Monitoring Program
(PDMP) and authorize the PDMP to monitor and report any suspicious behavior by
pharmacists, practitioners and any other authorized user of the online system.

AB 2619: Elder Financial Abuse
This bill would give victims of elder and dependant adult financial abuse priority over other wage garnishment earnings assignment orders, except orders for spousal and child support.  This allows victims of elder and dependant adult financial abuse, who are victorious in court but unable to collect from the defendant, a better opportunity to collect restitution through wage garnishments.

AB 2674: Solicitation of Murder
When an individual is convicted of solicitation for murder of their spouse, current law does not prohibit future attempts to reap financial benefit from the marriage, such as community property in retirement and pension benefits, from their injured spouse.  AB 2674 protects the victim by eliminating access the convicted partner may have to the victim’s benefits and property rights and ceases all financial support or insurance coverage the convicted spouse was receiving.

AB 2698: Foster Youth and Identity Theft Protection
This bill would build on and clarify a former bill as part of a bipartisan foster care package. AB 2698 requires the county welfare department to review the credit check for a foster youth within a year of their 16th birthday to determine if identity theft might have occurred.  If there appears to be identity theft, the county would then refer the youth to an organization for assistance.

AB 2737: 2-1-1 Phone System
AB 2737 provides the framework to designate a lead entity that will receive and direct federal funding to further expand the 211 phone system state-wide.  This bill also exempts 211 information and referral services provider and employees that provide information to the 211 phone system from liability in a civil action case for injuries or losses to a person or their property.

AJR 12: Resolution to Close Federal Loopholes for Corporate Tax Sheltering
AJR 12 would request that the President and Congress of the United States enact legislation that closes federal tax loopholes which corporations use to shelter taxable income in overseas tax haven countries. This resolution encourages transparency, cooperation, and tax compliance by corporations, and would allow for states to see added benefit from recaptured income wrongly stored overseas.
