2012 Legislative Proposals

AB 369 - Improving Patient Care: Limits an all-too-common practice used by health insurance companies known as "step therapy" or "fail first." Step therapy or fail first protocols require patients to experiment with various pain medications - including over-the-counter pain medications - before getting the one originally prescribed by their doctor. Oftentimes patients have to "fail" up to five times before they are finally given the prescription that their doctor originally prescribed. This bill ensures that your doctor, not your insurance company, decides which pain medication is best for you.

AB 693 - Organ Donations: To promote organ donations and help save lives, this bill requires the Department of Motor Vehicles (DMV) to create a hyperlink on its website to the state's Organ and Tissue Donor Registry, known as Donate Life California. This will give drivers more opportunities to donate organs by giving them the option to register as an organ donor when they annually renew their vehicle registration on-line, in addition to every five years when they renew their driver's license.

AB 864 - Distributed Generation for Industrial Users: This bill provides incentives to large, industrial energy users to invest in clean power. Not only do these companies use large amounts of power, they are also situated on large, developed, industrial sites, which offer a perfect opportunity for placing large scale distributed generation energy projects without impacting open space or sensitive habitats. This proposal will create green jobs to develop and install projects, while helping California businesses reduce their energy costs, reduce their carbon footprint, and meet clean air goals.

AB 1299 - Forage Species Conservation and Management Act: Requires future fishery management plans to consider the value of forage species, which are listed in the bill, as prey for larger fish, sea birds, mammals and turtles. Forage species, small sea creatures and invertebrates, contribute to the health and vitality of our ocean ecosystems through their role as prey in healthy ocean ecosystems.

AB 1530 – Clean Manufacturing and Job Creation Incentive Act: The manufacturing industry is vital to California’s economic recovery, providing high-wage jobs for skilled workers, and stimulating growth in other sectors of the economy. AB 1530 creates Clean Manufacturing Zones around the state, to attract new manufacturing businesses to California, and encourage existing businesses to stay and grow, by eliminating regulatory delays and providing tax incentives to locate here in California.

AB 1589 – California State Parks Stewardship Act: Identifies new revenue enhancement opportunities for state parks, including enhanced fee collection within state parks, a new state park environmental license plate, and tax incentives for purchase of state park access passes; creates a state park enterprise fund; modifies the criteria and public disclosure requirements for state park closures; places a cap on the number of state park closures that can be implemented without advance notification to the Legislature; and states legislative intent that a multi-disciplinary advisory council conduct an independent assessment and make recommendations for the long-term management and funding of California’s state park system.

AB 1601 – Oil Spill Prevention: Increases and caps the nontank per-vessel fee, which is required for a vessel to receive a certificate of financial responsibility from the Office of Spill Prevention and Response, at $3,250.

AB 1671 – Building Construction Jobs: Boosts opportunities for California small businesses to bid on valuable contracts for state transportation projects, and removes burdensome regulations by the California Department of Transportation that creates significant cash flow problems for many contractors.

AB 1704 – Coal Tar Sealant Ban: Prohibits the sale and use of coal tar pavement sealant, a toxic black liquid sprayed on some parking lots and driveways. Coal tar sealants degrade over time from tire friction and release high amounts of toxic chemical dust that wash into storm drains and into California’s waterways, contaminating aquatic ecosystems critical to the food chain. This bill will prevent unnecessary environmental pollution and protect families and children living in homes near paved parking lots from noxious indoor air pollution.

AB 1738 – Smoking Cessation Coverage: Requires health plans to cover over-the-counter medications, prescriptions, and counseling to help individuals quit smoking. Cigarette smoking is the leading cause of preventable death and disease, accounting for approximately 443,000 deaths, or 1 of every 5 deaths each year. This bill is designed to reduce the staggering toll of disease, disability, and death caused by tobacco use.

AB 1805 – Military and Overseas Voters: Ensures that our nation’s overseas military and international support personnel can vote in the local and state elections of the communities they call home. These servicemen and women have strong ties to those communities through their families and friends, and deserve the ability to help determine the leadership and direction of those communities by exercising their right to vote.

AB 1961 – Coho Salmon Habitat Enhancement Leading to Preservation (HELP) Act: Coho salmon have virtually disappeared in some areas of California; in other areas they are teetering on the brink of extinction. Under this bill the California Department of Fish and Game can more efficiently and effectively work with governmental and non-governmental partners to approve immediate on-the-ground habitat restoration projects to aid California’s struggling Coho salmon populations.

AB 2305 – Level Playing Field for Small Businesses Act: Franchisees don’t actually “own” their own business. Instead, they operate one of the corporation’s businesses according to often-changing corporate standards and procedures. While this may make sense to protect the corporate brand and image, abuses by some multinational companies have resulted in their small business franchisees losing everything trying to fight honest battles against intentionally unfair practices. AB 2305 tempers some of the unreasonable advantages that corporate franchisors have while addressing significant concerns of franchisees.

AB 2402 – Fish and Wildlife Strategic Vision: Implements recommendations of a state Executive Committee, Blue Ribbon Citizen’s Commission and Stakeholder Advisory Group on a strategic vision for the Department of Fish and Game and Fish and Game Commission, to improve the effectiveness of the Department and Commission in protecting and managing California’s fish and wildlife for the benefit and use of the people of the state.

ACR 20 – Water Awareness Month: Designates May 2012 as Water Awareness Month because May is typically the time when warm weather approaches and, with it, increased water use. ACR 20 recognizes the vital role that water plays in the lives of people, animals, ecosystems and economy of the State of California and stresses that water conservation is the most cost-effective and environmentally sound solution to reducing demand and using the state's water resources efficiently.

AJR 20 – Gulf of the Farallones and Cordell Bank National Marine Sanctuaries Boundary Modification and Protection Act: Calls on Congress and the President to quickly pass and sign into law expansion of the two named marine sanctuaries in order to preserve one of the most biologically rich marine areas in the world within one of the four coastal upwelling zones on the planet comprising only one percent of the ocean yet producing 20 percent of the world’s fish as well as providing important passages for endangered salmon and steelhead, essential haul sites for seals and sea lions, migration corridors for the California gray whale and other whale species, and prolific nurseries for hundreds of other aquatic species.
